Website Terms and Conditions
Last updated: 13 October 2026
1. About us and these Terms
1.1 Irish Flavours is an online ordering platform operated by Umbak Technologies Ltd ("Irish Flavours", "we", "us", "our"), a company registered in Ireland under company number 813183, with its registered office at The Conifers, Barran, Blacklion, Co Cavan. Contact: info@umbaktechnologies.com
1.2 These Terms and Conditions ("Terms") apply to your use of our website, mobile site and any apps (together the "Platform") and to orders you place through it. By using the Platform or placing an order, you agree to these Terms. If you do not agree, please do not use the Platform.
1.3 Please read these Terms together with our Privacy Policy and, if you use cookies, our Cookie Policy.
2. What we do (and what we don't)
2.1 The Platform lets you browse and order food, drink and other goods from independent takeaways, restaurants, retail stores and other businesses ("Merchants").
2.2 We are an intermediary. When you place an order, the sale contract for the goods is between you and the Merchant. Irish Flavours provides the technology that lets you place the order, takes payment on the Merchant's behalf where applicable, and passes your order to the Merchant. Unless we clearly say otherwise, we do not prepare, sell, stock or deliver the goods ourselves.
2.3 Merchants are responsible for their menus, prices, product descriptions, allergen and ingredient information, food safety and hygiene, preparation, packaging, and (where they deliver themselves) delivery.
3. Using the Platform
3.1 You must be at least 18 years old to create an account or place an order, and you must be able to enter into a binding contract.
3.2 You may need an account to order. You must give accurate and up-to-date information, keep your login details confidential, and tell us promptly if you think someone else has used your account. You are responsible for activity on your account.
3.3 You agree not to:
- use the Platform unlawfully, fraudulently or to place false, prank or abusive orders;
- interfere with or disrupt the Platform, or attempt to gain unauthorised access to it;
- use bots, scrapers or automated tools without our written permission;
- abuse, threaten or harass Merchants, delivery staff or our team;
- misuse promotional codes or create multiple accounts to get offers you are not entitled to.
3.4 We may suspend or close your account, or refuse orders, if you breach these Terms or we reasonably suspect fraud or misuse.
4. Placing an order
4.1 How a contract is formed. When you submit an order you are making an offer to buy. Your order is accepted, and a contract between you and the Merchant is formed, when the Merchant (or we on its behalf) confirms it by on-screen message, email, text or app notification. The Merchant may decline or cancel an order, for example if an item is unavailable, the Merchant is closed or busy, or your address is outside its delivery area. If so, we will tell you and refund anything you have already paid for that order.
4.2 Please check your order, delivery address, contact number and any special instructions carefully before you submit. We and the Merchant are not responsible for errors in the information you give us.
4.3 Age-restricted products. Some Merchants sell products that cannot lawfully be sold to under-18s (for example alcohol, tobacco or vaping products). You confirm you are 18 or over when ordering them. The Merchant or delivery person may ask for photo ID and may refuse to hand over the order, without refund, if you cannot show you are old enough or no adult is available to receive it.
5. Prices and payment
5.1 Prices are set by Merchants, are shown in euro (€), and include VAT where applicable. The order total shown at checkout includes the price of goods, any delivery fee, any service or small-order fee, and any tip or discount you have applied.
5.2 Menu prices on the Platform may differ from prices in the Merchant's own premises.
5.3 Payment is taken at checkout by card, digital wallet or another method we show. Payments are processed by our third-party payment provider Stripe and/or AIB Merchant Services. We do not store your full card details. By paying, you also agree to the payment provider's terms.
5.4 If payment fails or is reversed, we may cancel the order. Cash on delivery or collection is available only where the Merchant offers it.
5.5 Where you pay a tip, it is passed to the Merchant or delivery person as described at checkout.
6. Delivery and collection
6.1 Estimated delivery and collection times are estimates only and are not guaranteed. Times may be affected by order volume, traffic, weather and other factors outside our control.
6.2 You must give a complete and accurate delivery address and be available to receive your order. If delivery cannot be completed because you are unavailable, uncontactable or gave the wrong address, the order may be cancelled and you may not be entitled to a refund.
6.3 For collection orders, please collect your order at the time stated. Food quality may suffer if it is left waiting.
6.4 Risk in the goods passes to you when they are delivered to you or collected.
7. Allergens and dietary information
7.1 Allergen and ingredient information is provided by Merchants, not by us. Irish Flavours does not prepare food and cannot verify that information.
7.2 If you have an allergy, intolerance or dietary requirement, contact the Merchant directly before you order to confirm the ingredients and preparation. Please also note that the Merchant may not be able to guarantee that food is free from cross-contamination.
7.3 Any notes you add to an order about allergies are passed on to the Merchant, but we cannot guarantee they will be read or acted upon. Contact the Merchant if it is important.
8. Cancellations, problems with your order and refunds
8.1 Cancelling an order. You can ask to cancel an order only before the Merchant has started preparing it. Contact the Merchant or us as soon as possible. Once preparation has started, we may not be able to cancel or refund it.
8.2 Right to cancel (14-day cooling-off). Under Irish and EU consumer law, consumers usually have 14 days to cancel distance purchases. However, this right does not apply to goods that are made to the consumer's specifications or clearly personalised, or that are liable to deteriorate or expire rapidly, which covers freshly prepared food and drink. Other goods supplied through the Platform (for example non-perishable retail goods) may be covered by the right to cancel, and the Merchant will tell you how to exercise it.
8.3 Faulty, missing or incorrect items. If your order arrives late, damaged, incorrect, incomplete or not of the quality you would reasonably expect, please contact us within 24 HOURS of delivery or collection with your order number and, where possible, a photo. We will work with the Merchant to put it right, which may include a replacement, a partial or full refund, or a credit, depending on the circumstances.
8.4 Your statutory rights. Goods you buy must be of satisfactory quality, fit for purpose and as described. Nothing in these Terms affects your legal rights as a consumer under Irish law, including the Consumer Rights Act 2022.
8.5 Approved refunds are returned to your original payment method, normally within 5–10 working days, although your bank may take longer to show it.
9. Promotions, vouchers and loyalty offers
9.1 Promotional codes, vouchers and discounts are subject to the specific terms stated with them (for example validity period, minimum spend, participating Merchants).
9.2 They have no cash value, cannot be exchanged for cash, and may not be combined unless stated. We or the Merchant may withdraw them if they are misused or obtained unfairly.
10. Reviews and user content
10.1 You may be able to post ratings, reviews, photos and comments ("Your Content"). You must ensure it is honest, based on your own experience, lawful, and not defamatory, offensive, misleading or infringing anyone's rights.
10.2 You keep ownership of Your Content, but you give us a free, worldwide, non-exclusive licence to use, display, reproduce and share it on the Platform and in our marketing, in connection with the services.
10.3 We may remove or edit content that breaches these Terms or that we reasonably think is inappropriate.
11. Intellectual property
11.1 The Platform, including the "Irish Flavours" name, logo, design, software, text and layout, is owned by or licensed to Umbak Technologies Ltd and is protected by intellectual property laws. Merchant names, logos, menus and images belong to the relevant Merchants.
11.2 You may use the Platform for your own personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute or commercially exploit any part of it without our written permission.
12. Availability and changes to the Platform
12.1 We try to keep the Platform available and accurate, but we do not guarantee it will be uninterrupted or error-free. We may suspend, change or withdraw features for maintenance, security or other reasons.
12.2 We may correct pricing, menu or other errors, and may cancel orders affected by an obvious error (with a full refund).
12.3 The Platform may contain links to third-party websites. We are not responsible for their content or practices.
13. Our liability
13.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
13.2 Subject to clause 13.1:
- As Merchants are responsible for the goods they sell, we are not liable for the quality, safety, legality, preparation, allergen content or description of those goods, or for a Merchant's failure to perform the contract. Please raise those issues with the Merchant or with us and we will help where we reasonably can.
- We are not liable for losses that were not a reasonably foreseeable result of our breach, or for loss of profit, business or goodwill (as you are a consumer, you are not using the Platform for business purposes).
- Our total liability to you in connection with any order or your use of the Platform is limited to the amount you paid for the order concerned.
13.3 We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, power or internet outages, industrial action or failures of third-party services.
14. Business accounts and Merchants
Merchants who list on the Platform do so under a separate Merchant Agreement with Umbak Technologies Ltd T/As Irish Flavours. If there is a conflict between these Terms and a Merchant Agreement, the Merchant Agreement applies as between us and the Merchant.
15. Privacy and cookies
We collect and use your personal data as set out in our Privacy Policy. By using the Platform you acknowledge that you have read it.
16. Complaints and disputes
16.1 If you have a complaint, please contact us first at info@umbaktechnologies.com and we will try to resolve it promptly. We aim to respond within [5] working days.
16.2 If we cannot resolve it, you may be able to use an alternative dispute resolution body. The Competition and Consumer Protection Commission (ccpc.ie) provides information on consumer rights and options. You also keep the right to go to court.
17. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in law or our services. The version in force when you place an order applies to that order. We will post the updated Terms with a new "last updated" date and, where changes are significant, notify you by email or on the Platform. Continued use after changes means you accept them.
18. General
18.1 Entire agreement. These Terms, together with the documents referred to in them, are the entire agreement between you and us about your use of the Platform.
18.2 Severability. If any part of these Terms is found unenforceable, the rest remains in force.
18.3 No waiver. If we do not enforce a right straight away, that does not mean we have given it up.
18.4 Transfer. We may transfer our rights and obligations under these Terms to another company, provided this does not reduce your rights. You may not transfer yours without our written consent.
18.5 Third parties. Only you and we have rights under these Terms, except where they expressly say otherwise.
18.6 Governing law and courts. These Terms and any dispute arising from them are governed by the laws of Ireland. If you are a consumer, you may bring proceedings in the Irish courts, and you also keep the benefit of any mandatory consumer protection laws of the EU country where you live. The Irish courts have jurisdiction, except where mandatory consumer law gives you the right to bring proceedings elsewhere.
